These Terms of Service outline the rights and responsibilities between you (the "Client") and NetworkBuilder (the "Service Provider"). We've written these terms in clear, simple language because we believe in transparency and building trust with our clients.

We are committed to providing high-quality digital solutions while maintaining fair and honest business practices. Our "See Before You Pay" model and flexible refund policy reflect our confidence in our work and our commitment to your satisfaction.

1. Agreement to Terms

By accessing or using NetworkBuilder's services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

NetworkBuilder ("we," "us," or "our") provides website development, mobile application development, AI solutions, and related digital services to small businesses, particularly in tier 3 cities.

2. Our Services

NetworkBuilder offers the following services:

  • Website Development (Static, Semi-Dynamic, and Full Dynamic)
  • Mobile Application Development (React Native)
  • Backend and Database Solutions
  • AI-Powered Solutions and Automation
  • Maintenance and Support Services
  • Domain Registration and Hosting
  • Digital Marketing Setup

3. Free Preview Policy

We offer a unique "See Before You Pay" model where we build 30-50% of your project as a free preview. This preview:

  • Requires no upfront payment
  • Is a working demonstration, not just mockups
  • Can be shared for feedback
  • Has no watermarks or restrictions during the preview period
  • Does not obligate you to proceed with the full project

If you choose not to proceed after the preview, you may walk away with no cost or obligation.

4. Payment Terms

Payment Structure:

  • 0% Upfront: No payment required to start the preview
  • 50% After Preview Approval: Once you approve the preview and decide to proceed
  • 50% Upon Completion: Final payment when the project is complete and ready for launch

Accepted Payment Methods:

  • UPI (Google Pay, PhonePe, Paytm, etc.)
  • Bank Transfer (NEFT/RTGS/IMPS)
  • Cash (for local clients in Malda area)

All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.

5. Refund and Cancellation Policy

We are committed to your satisfaction, and our refund policy reflects our trust-first approach.

5.1 Preview Stage (Before First Payment)

Since no payment has been made, you can cancel at any time with no charges or questions asked.

5.2 After First Payment (50% Paid)

If you wish to cancel after making the first payment:

  • We will discuss your concerns and attempt to resolve any issues
  • If we mutually agree that the concerns are valid and cannot be resolved through revisions, a refund will be processed
  • Refund amount will be determined based on work completed and resources utilized
  • Processing time: 7-14 business days

5.3 After Project Completion (100% Paid)

If you request a refund after the project is completed and launched:

  • You must provide specific reasons for dissatisfaction
  • We will review your concerns and attempt to resolve them first
  • Refunds will only be issued if we both agree that there is a genuine problem that cannot be fixed
  • We reserve the right to assess whether the issue is valid and warrants a refund
  • Partial refunds may be offered based on the nature of the issue

Important: Refund eligibility requires mutual agreement between you and NetworkBuilder that a genuine problem exists which can only be resolved through a refund. We commit to honest assessment and fair resolution.

5.4 Non-Refundable Items

  • Third-party costs (domain registration, hosting fees, SSL certificates)
  • Maintenance plan fees already utilized
  • Add-on services already delivered (logo design, content writing, etc.)
  • Changes in your business requirements or personal preferences after approval

5.5 Our 30-Day Money Back Guarantee

We offer a 30-day satisfaction guarantee from the project launch date. If you encounter any technical issues or functional problems that we cannot resolve within this period, you are eligible for a full or partial refund as per mutual agreement.

6. Project Timeline and Delivery

Estimated Timelines:

  • Preview: 3-7 days
  • Static Website: 7-10 days
  • Semi-Dynamic Website: 12-15 days
  • Full Dynamic Website: 20-30 days
  • Mobile Applications: Custom timeline (discussed during consultation)

Timelines may vary based on project complexity, client feedback response time, and revision requests. We will keep you informed throughout the development process.

7. Revisions and Changes

Each project includes a specific number of free revisions as per the pricing plan:

  • Static Website: 2 free revisions
  • Semi-Dynamic Website: 3 free revisions
  • Full Dynamic Website: 5 free revisions

Additional revisions beyond the included amount may incur extra charges. Major changes in project scope will be discussed and may require additional fees.

8. Client Responsibilities

To ensure smooth project completion, clients must:

  • Provide accurate business information and content
  • Respond to our queries and requests in a timely manner
  • Provide necessary materials (logos, images, content) as required
  • Review and provide feedback on preview and drafts promptly
  • Make payments as per agreed schedule
  • Maintain professional communication

Delays in client responses may extend project timelines.

9. Intellectual Property

Your Content: You retain all rights to content, images, and materials you provide.

Our Work: Upon full payment, you receive ownership of the final deliverables. However:

  • We retain the right to use the project in our portfolio
  • Source code and custom frameworks developed by us remain our intellectual property
  • We may reuse general code snippets and frameworks in other projects

Third-Party Resources: Some projects may use third-party libraries, frameworks, or resources (e.g., React, Next.js, icons, fonts) which are governed by their respective licenses.

10. Maintenance and Support

We offer three maintenance plans:

  • Basic Plan (₹500/month): Hosting, domain renewal, 2 minor updates, email support
  • Standard Plan (₹1,000/month): Everything in Basic + 5 updates/month + priority support + monthly backup
  • Premium Plan (₹2,000/month): Everything in Standard + unlimited minor updates + phone support + weekly backup

Maintenance plans are optional but recommended for optimal website performance and security.

11. Warranties and Disclaimers

We Guarantee:

  • Websites will be mobile-responsive and cross-browser compatible
  • Basic SEO setup will be implemented
  • Websites will be functional and meet agreed-upon specifications
  • We will fix any bugs or technical issues discovered within 30 days of launch

We Do Not Guarantee:

  • Specific search engine rankings or traffic volumes
  • Specific business results or revenue increases
  • 100% uptime (though we strive for maximum reliability)
  • Compatibility with all future browser updates or technology changes

12. Limitation of Liability

NetworkBuilder shall not be liable for:

  • Loss of business, revenue, or profits
  • Data loss due to third-party hosting issues
  • Damages resulting from client-provided content or materials
  • Indirect, consequential, or incidental damages

Our total liability shall not exceed the total amount paid for the specific service in question.

13. Confidentiality

We respect your privacy and business confidentiality. We will:

  • Keep your business information confidential
  • Not share your data with third parties without consent
  • Use secure methods for file transfers and communications
  • Not use your project in our portfolio without your permission

14. Termination

Either party may terminate the service agreement:

  • By mutual written agreement
  • If the other party breaches these terms and fails to remedy within 7 days
  • For non-payment after 15 days of invoice due date

Upon termination, payments will be settled based on work completed, and all project files in our possession will be provided to the client (if applicable).

15. Dispute Resolution

We believe in open communication and fair resolution. If any disputes arise:

  • We will first attempt to resolve through direct communication
  • If unresolved, we will arrange a formal discussion to understand both perspectives
  • Both parties will work in good faith to find a mutually acceptable solution
  • If necessary, disputes will be resolved through arbitration in Malda, West Bengal

16. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be:

  • Posted on this page with an updated "Last Updated" date
  • Communicated to active clients via email
  • Applicable to new projects immediately
  • Applicable to existing projects from the date of notification

17. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the jurisdiction of courts in Malda, West Bengal.
